1. Use of the Online Store

You may use sinoitax.shop for lawful shopping and other legitimate purposes.

You must not use our website:

  • For unlawful activity;
  • To commit fraud;
  • Using stolen payment information;
  • To impersonate another person;
  • To interfere with website security;
  • To introduce malware or malicious code;
  • To obtain unauthorised access;
  • To scrape content unlawfully;
  • To violate intellectual-property rights;
  • To submit materially false information; or
  • To interfere with another person's use of the website.

We may take proportionate measures to protect our website, customers and systems against abuse.

2. Legal Capacity

By placing an order, you represent that you have legal capacity to enter into the transaction or that an appropriate parent, guardian or authorised person is involved where required.

3. Product Information

We make reasonable efforts to provide accurate product descriptions, photographs, pricing and availability information.

Customers should review product information and selected options before ordering.

Minor visual differences resulting from screens, lighting or photography may occur.

This does not affect rights where goods are materially different from their description or fail to satisfy applicable consumer guarantees.

4. Prices

Prices displayed through sinoitax.shop are intended to be clear and accurate.

Applicable charges will be disclosed during checkout before the order is submitted where required.

Australian businesses must communicate clear and accurate prices and must not mislead consumers about pricing.

Prices and promotions may change before an order is accepted.

5. Obvious Errors

Occasionally, technical, typographical or pricing errors may occur.

Where we identify an obvious error before an affected transaction is completed or fulfilled, we may contact the customer and provide reasonable options.

If an order is cancelled because it cannot reasonably or lawfully be fulfilled following an obvious error, amounts already paid for the cancelled products will be refunded.

6. Orders

Submitting an order constitutes an offer to purchase the selected products.

After submission, customers may receive an electronic acknowledgement.

An automated acknowledgement does not necessarily mean that an order has completed all payment, fraud, availability and fulfilment checks.

We may refuse or cancel an order on reasonable grounds, including:

  • Product unavailability;
  • Payment failure;
  • Suspected fraud;
  • Obvious pricing error;
  • Incorrect product information;
  • Shipping restrictions; or
  • Circumstances preventing lawful fulfilment.

Any cancellation will be administered consistently with applicable law.

7. Payment

Payment methods available for an order are displayed during checkout.

Customers must provide accurate payment and billing information.

Payment processing may be performed through Shopify-supported payment technology or independent financial service providers.

8. Fraud Prevention

Orders may be subject to reasonable anti-fraud and security checks.

We may request additional verification where reasonably necessary.

We will not use fraud-prevention procedures arbitrarily or to avoid legitimate consumer obligations.

9. Product Availability

Products are offered subject to availability.

Inventory errors, simultaneous purchases, supplier changes or technical errors may occasionally affect availability.

If an item cannot be supplied after payment, we will contact the customer and provide an appropriate solution, including a refund where required.

10. Shipping

All orders receive free standard shipping.

Our estimated standard delivery timeframe is 15–20 calendar days.

Additional details are set out in our Shipping Policy.

Delivery estimates should be read as reasonable estimates subject to genuine circumstances outside our reasonable control, rather than permission for indefinite delay.

Where products cannot be supplied within an agreed or reasonable period, Australian consumer law may require an appropriate solution.

11. Delivery Information

Customers are responsible for providing complete and accurate delivery information.

If an address appears incomplete or incorrect, we may contact the customer before dispatch.

Additional costs arising solely from an incorrect address supplied by the customer may be the customer's responsibility where lawful and reasonable.

12. Risk and Delivery Problems

If a shipment appears lost, materially delayed or incorrectly delivered, contact:

info@sinoitax.shop

We will review available tracking and carrier information and provide an appropriate resolution.

Nothing in these Terms transfers legal responsibility in a manner inconsistent with mandatory consumer law.

13. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy.

We provide a voluntary 30-day change-of-mind return policy for qualifying products.

That voluntary policy is separate from statutory Australian Consumer Law rights.

Australian consumers automatically receive consumer guarantees, and store policies cannot override those guarantees.

14. Consumer Guarantees

Products sold to Australian consumers are subject to applicable consumer guarantees.

Depending on the nature of a failure, remedies may include repair, replacement, refund, cancellation or compensation.

Nothing in these Terms attempts to exclude or restrict such rights where doing so would be unlawful.

15. Promotions and Discount Codes

Promotions may be governed by conditions displayed with the relevant offer.

Unless otherwise stated:

  • Promotional offers are subject to availability;
  • Discount codes must be applied during checkout;
  • Discounts cannot be redeemed for cash;
  • Multiple discounts may not always be combined; and
  • Fraudulent or abusive use may result in cancellation where legally permitted.

Promotion conditions will not override mandatory consumer rights.

16. Intellectual Property

Unless otherwise indicated, website content including text, graphics, layout, branding elements and other original material is protected by applicable intellectual-property laws.

You may access the website for ordinary personal shopping purposes.

You may not reproduce, commercially exploit, republish or distribute protected content without appropriate permission except where permitted by law.

Third-party trademarks and materials remain the property of their respective owners.

17. Reviews and User Content

Where our website allows reviews, comments or other submissions, users must not submit content that is unlawful, defamatory, fraudulent, threatening, infringing, deceptive or malicious.

We may moderate content where reasonably necessary to maintain website integrity or comply with legal obligations.

We will not knowingly manipulate customer reviews in a manner that misleads consumers.

Australian Consumer Law rules against misleading conduct also apply to representations made online, including product claims and online reviews.

18. Third-Party Services

Certain website functions may be provided by third parties including Shopify, payment providers, carriers, analytics providers and fulfilment providers.

Third-party services may have independent terms.

Our use of third parties does not exclude responsibilities that legally remain ours as the seller.

19. External Links

Our website may contain links to independent websites.

A link does not necessarily constitute endorsement.

We are not responsible for independent third-party content or services except to the extent responsibility cannot lawfully be excluded.

20. Website Availability

We aim to maintain reasonable website availability.

Temporary interruptions may occur because of maintenance, security incidents, network problems or service-provider outages.

We do not guarantee uninterrupted access at all times.

This provision does not exclude rights or remedies that cannot lawfully be excluded.

21. Limitation of Liability

To the maximum extent permitted by law, we are not responsible for losses that are not reasonably attributable to a breach by us or that arise solely from circumstances outside our reasonable control.

However, nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot legally be excluded.

Where the Australian Consumer Law applies, these Terms are intended to operate subject to that law.

22. No Exclusion of Statutory Rights

Any disclaimer or limitation in these Terms applies only to the maximum extent permitted by law.

If a provision conflicts with a mandatory statutory right, the mandatory statutory right prevails.

23. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy requirements.

Please review our Privacy Policy before providing personal information.

24. Changes to These Terms

We may update these Terms prospectively when reasonably necessary due to changes in our services, technology, business practices or legal requirements.

Updated Terms will be published on sinoitax.shop.

Changes will not retrospectively remove accrued consumer rights.

25. Severability

If a particular provision is held invalid or unenforceable, that provision will be interpreted or severed to the minimum extent necessary where legally permitted.

The remaining provisions continue to operate to the extent legally possible.

26. No Waiver

A failure to enforce a provision on one occasion does not necessarily constitute a permanent waiver of that provision or any legal right.

27. Governing Law

These Terms are governed by applicable laws of Australia and any applicable state or territory laws determined according to the circumstances of the transaction.

Nothing in this clause prevents a consumer from relying on mandatory protections or bringing a claim in a forum available under applicable law.

Australian businesses selling goods or services must comply with applicable national, state and territory fair-trading requirements.
